Another Day – Another Lie from the Police Union

We have The Police Association has appeared on TVNZ’s Breakfast Show this morning.

Imagine shooter’s surprise to learn that you don’t need a gun license to buy ammunition in New Zealand. 

Oh and that security is not checked by Police when issuing Firearm Licenses.

The Police Association President Chris Cahill wouldn’t know the truth if it bit him.

The Kiwi Gun Blog has just called the producers of the show. Both to inform them of the man’s deceit and to request use of the footage.

Its time that we collected this man’s lies into a montage. Radio, print, television, legal submissions. All of it. Then we can show it to the media and the politicians and his members.

So everyone can understand that the Police Union now has zero credibility.

In the meanwhile… The Kiwi Gun Blog has suggested to some friends in the Police that they investigate how to remove this clown from within the Association. If anyone deserves a vote of no confidence – it is this liar.

If only for the damage that he has done, not only to the reputation of the organisation but to the relationship between the Police officers on the street and the shooters who used to love them.

We will follow this up with a complaint to the Broadcasting Standards Authority.

We have also asked for an on air correction – you should as well.

    1. First email with the words “I wish to make a formal complaint” on the grounds of inaccuracy and lack of balance. THEN you complain to the Broadcasting Standards Authority AFTER you get a response from the broadcaster – TVNZ. Its easy – dont be intimidated. The more who do this the better.

  4. It is unlawful to supply ammunition to an unlicenced person unless under the direct supervision of a Licence holder – i.e. actually using the ammunition under suprvision or examining a collection item under supervision.

    It is unlawful to possess ammunition unless it is for for a lawful and sufficient reason – even for Licence holders.

    There have been several successful prosecutions for unlawful possession by unlicenced occupiers of dwellings – the law states that they are the possessor even if they do not know it is there unless they can prove it is not theirs and show to whom it does belong.

    So Cahill is technically correct that persons do not need a licence to either buy or possess ammunition but it is tightly controlled and they may not actually possess it or have it supplied to them without a licence. They may own it (i.e. have title to it) BUT may not lawfully possess ammunition unless under immediate supervision of a Licence holder.

    Making it unlawful to possess ammunition entirely would prevent use under supervision – perhaps the outcome he is angling for?

    He is being VERY misleading – but perhaps not quite an outright lie

      1. Don’t fall into the ‘Cahill Trap’

        There is no prohibition of the unlicenced either purchasing or possessing ammunition – indeed they may possess it with lawful and sufficient purpose. They may have title to it as long as they do not ‘possess’ it without supervision.

        There is a prohibition of the supplying of ammunition to the unlicenced – except if there is lawful and sufficient purpose.

        As anything not prohibited is allowed – find the prohibition in the law.

        Once all unlicenced are prohibited from possessing ammunition each licence holder will have to remove ALL ammunition from their dwelling when ever they leave it in occupation by unlicenced persons.

        The law has been carefully written to allow use under supervision and provide lawful and sufficient reasons for the unlicenced to occupy a place where ammunition is stored by a Licence holder.

        The statement that one cannot buy ammunition without a licence is clearly not true. Cahill is technically correct – just neglects to mention that the unlicenced cannot possess ammunition without lawful and sufficient purpose

      (1) Every person commits an offence and is liable on conviction to a fine not exceeding $1,000 who sells or supplies ammunition for any firearm or restricted weapon to a person who is not—
      (a) the holder of a firearms licence; or

      Police Mail Order form S 43A
      Firearms Licence: You require a firearms licence to possess firearms,
      or ammunition for them, and some special categories of airgun.

      Sales: Sellers / suppliers of firearms, ammunition and airguns are
      required by the Arms Act 1983 to ascertain that the purchaser / recipient
      is the holder of a firearms licence or is of or over the age of 18 years in
      the case of airguns.

      1. The prohibition is on the supply not on the possession. There is no specific prohibition upon possession as long as it is for lawful and sufficient purpose.

        No where is possession ( for lawful and sufficient purpose) prohibited – It is the supplier who commits the offence. Not the possessor – whether licenced or not.

        43B Restriction on the slae of ammunition is the law.

        The guff on the Mail Order form is Police opinion. Sellers are even there tasked with selling to licenced persons BUT unlicenced persons commit no offence if in possession of ammunition as long as they have a lawful and sufficient purpose – like using it under supervision – otherwise if possession was prohibited that could not do even that.

        It is all in the semantics – There is no actual prohibition in law of possession – only a requirement to have lawful and sufficient purpose.

        Read the LAW carefully and realise that Police opinion means diddly squat to a Judge – who will decide for themselves what the Statute means!

  6. I decided to send video and relevant legislation to Police Minister, this guy needs to be roped in…i’ve never seen such rabid hate for firearms owners, uneducated Antis are one thing, but this guy should know the legislation.

  7. What would have been a fairer approach is to have this Cahill character and a representative of the LFAO community speaking on our behalf in a TV interview.

    I think that would quickly refute Cahill’s claims that law-abiding firearm owners are not going to be unduly affected by these proposed changes.

    Thanks for reminding us to read about the proposed changes – don’t worry, we have, they are a contradictory and enforceable waste of tax paying money that addresses a quite non-existential problem.

    Keep digging Cahill – eventually you’ll dig too deep and won’t be able to get out.
